Your right to leave when your partner or wife gives birth to your child has changed. With effect from 1 January 2015, as a partner or husband you are entitled to 3 days’ parental leave. Your employer cannot refuse to allow you to take these 3 days.
In Article 8.14 the CLA Banks provides that during parental leave you are entitled to 50% of your monthly income for a maximum period of four weeks. The 3 days’ parental leave are included in this 4 weeks’ period.
Should it prove necessary you can request compassionate leave when your partner or wife gives birth. Compassionate leave is paid leave.
In addition to this, you are legally entitled to 2 days of fully paid paternity leave. Your right to paternity leave does not increase in the case of a multiple birth. If your partner or wife gives birth at home, you should take your paternity leave within 4 weeks after the birth of your child. If your partner or wife gives birth in hospital, you should take your leave within 4 weeks after your baby comes home from hospital. You should notify your employer as soon as possible as to when you intend to take paternity leave. You can do this verbally or in writing. Your employer cannot refuse to allow you to take this leave.
